Kirby Project Hub

This license is a legal agreement between you and Gunther Groenewege for the use of the Kirby Project Hub Theme (the “Product”). By downloading and/or using the Product you agree to be bound by the terms and conditions of this license. Gunther Groenewege reserves the right to alter this agreement at any time, for any reason, without notice. This version was last updated April 14th, 2015.

The Basics

The license gives you or your company the right to use the Product in personal or commercial projects for yourself, clients or others. The Product cannot be resold or redistributed on its own, or used in another product offered for sale where the Product becomes the core value.

Permitted Use

Each user requires 1 license. Additional users outside of the allowed number of users or any other use of the Product requires an additional purchased license or custom license. To inquire about a custom license please contact info@g-design.net

Restrictions

Unless you have been granted prior, written consent from Gunther Groenewege, you may not: 1. Reproduce, distribute, share or transfer the Product, or portions thereof, to any third party, for sale or even for free.  2. Sell, rent, lease, assign, or sublet the Product or portions thereof. 3. Grant rights to any other person. 4. Use the Product in violation of any U.S. or international law or regulation. 

Making Copies

You may make copies of the Product for back-up purposes only.

Modification

You may alter, modify, or extend the Product for your own use, or commission a third-party to perform modifications for you, but you may not resell, redistribute or transfer the modified or derivative version without prior written consent from Gunther Groenewege 

Support

Support specific to the Product is available through info@g-design.net. No warranty is provided and no liability is assumed by Gunther Groenewege for support services offered or provided. No representations or guarantees are made regarding the response time in which support questions are answered.

Indemnity

You agree to indemnify and hold harmless Gunther Groenewege for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Product, or a violation of any terms of this license.

Disclaimer Of Warranty

THE PRODUCT IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, Gunther Groenewege DOES NOT WARRANT THAT THE PRODUCT OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.

Limitations Of Liability

YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND/OR USE OF THE PRODUCT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF THE PRODUCT BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE PRODUCT. LICENSE HOLDERS ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE AND ASSUME ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISKS OF PROGRAM ERRORS, DAMAGE TO EQUIPMENT, LOSS OF DATA OR SOFTWARE PROGRAMS, OR UNAVAILABILITY OR INTERRUPTION OF OPERATIONS.
